Recent changes in law have simplified the divorce process making it less acrimonious and more straightforward as the ‘no-fault’ divorce system means that the only requirement is to state that the marriage has broken down irretrievably removing the need to provide a specific reason for the separation.

The application for divorce is dealt with using the online service and many couples may not consult a family lawyer prior to starting the divorce process.  However, some people may not realise that while the final divorce order ends the marriage, it does not address financial matters, and a separate financial order is necessary in order to resolve these issues.  For example, if you do not have a court order dismissing all claims your ex-spouse could pursue you for a subsequent inheritance.  Couples also may not be aware that obtaining the final divorce order before resolving the financial issues by way of court order can affect pension rights, tax and inheritance issues.  For this reason, it is very important for a financial settlement to be considered as soon as possible, including in circumstances where the parties simply want to ensure that they have no further financial claims against the other, commonly referred to as a ‘clean break’.  Any agreement in relation to the finances, including a clean break, must be embodied in a court order to avoid future claims or issues.
